Terms of Service

You may register using an email address and password, or via a supported third-party OAuth provider (e.g., Google). You agree to provide accurate, complete, and current information during registration and to keep it updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at hello@virality-labs.com if you suspect unauthorized access. We are not liable for losses resulting from unauthorized use of your account.

Each person may maintain only one free account. Creating multiple accounts to circumvent credit limits or usage restrictions is prohibited and may result in permanent termination of all associated accounts.

The Service is offered on a freemium basis. Free accounts receive a limited credit allocation. Paid plans (Starter, Growth, or equivalent) are available on a monthly or annual subscription basis and provide higher credit allocations and additional features.

Credits are consumed each time you submit a video for analysis. Credit allocations refresh at the start of each billing period. Unused credits do not roll over to the next period unless explicitly stated in your plan description. Credits have no monetary value and are not redeemable for cash.

Paid subscriptions are billed in advance on a recurring basis (monthly or annually). By subscribing, you authorise us to charge your payment method automatically at each renewal period. You can cancel at any time; cancellation takes effect at the end of the current billing period and you retain access until then.

We offer a 7-day refund on new subscriptions if you have consumed fewer than 3 credits in that period. Requests must be submitted to hello@virality-labs.com within 7 days of the charge. Refunds are not available for renewals, annual plan mid-term cancellations, or accounts found to have violated these Terms.

We may change subscription prices with at least 30 days' notice via email. Continued use after the new pricing takes effect constitutes acceptance. If you do not accept the new price, you may cancel before it applies.

All prices are exclusive of applicable taxes (VAT, GST, sales tax, etc.) unless stated otherwise. You are responsible for any taxes applicable in your jurisdiction.

You retain full ownership of all video content, titles, and materials you submit to the Service ("Your Content"). These Terms do not transfer any ownership rights to us.

By submitting Your Content, you grant Virality Labs a limited, non-exclusive, worldwide, royalty-free licence to process, analyse, transcode, and store Your Content solely to provide the Service to you. This licence terminates when the content is deleted from our systems in accordance with our retention policy.

You are solely responsible for Your Content and represent that: (a) you own it or have the right to submit it; (b) it does not infringe any third-party rights; and (c) it does not violate any applicable law or these Terms.

We do not use Your Content to train, fine-tune, or improve AI models made available to other users. Aggregated, anonymised, non-attributable statistics (e.g., average engagement scores across a category) may be used for internal product improvement.

The Service, including its software, algorithms, scoring models, design, trademarks, and all content we create, is owned by or licensed to Virality Labs and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our IP without prior written consent.

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free licence to use that feedback for any purpose without compensation or attribution to you.

Titles, hashtags, descriptions, and hook rewrites generated by the Service are produced specifically for you based on your content. You may use these outputs freely in your YouTube channel and related content. You may not resell these outputs as part of a competing service.

You may close your account at any time from your Account Settings. Upon closure, your data will be deleted in accordance with our Privacy Policy. Any unused credits are forfeited upon account closure and are non-refundable unless the 7-day refund policy in Section 5.4 applies.

We may suspend or terminate your account immediately, without notice or refund, if:

• You breach these Terms
• We are required to do so by law
• Continued provision of the Service to you would expose us to legal or reputational risk
• Your account is used for fraudulent or abusive activity

For non-material breaches, we will typically provide a warning before termination.

Upon termination, your right to use the Service ceases immediately. Sections 7 (ownership provisions), 8, 9, 12, 13, 14, and 15 survive termination.

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Virality Labs is registered, without regard to conflict of law principles.

Before filing any formal legal claim, you agree to contact us at hello@virality-labs.com and give us 30 days to attempt to resolve the dispute informally.

Nothing in these Terms limits or excludes any statutory rights you may have as a consumer under applicable EU or UK law, including rights under the Consumer Rights Act 2015 (UK) or equivalent EU consumer protection legislation. If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
